Please i need and advice! a woman crashed into my apartment!?

A lady crashed her vehicle into my apartment a week ago she was drunk and after the accident my wife came out to see what happened and this lady threat my wife saying to stay away because she had HIV and she would bite her then after that she ran from the scene the police arrived and pulled the records of the car which it was still in my living room the lady who crashed lives right across the street so they went to arrest her, there's a claim already with her insurance but i was wondering if i can sue her for making threats to my wife right after she crashed in to the apartment?Please i need and advice! a woman crashed into my apartment!?
A threat is a criminal action not a civil one. No damages to sue for beyond the actual accident damage.





Doubt any jury would hold yer responsible for anything she said while drunk and after being involved in a concussive crash.Please i need and advice! a woman crashed into my apartment!?
Your wife can claim that she was in mortal fear for her life, that the threat caused her blood pressure to spike through the roof and exacerbated an existing medical condition, that she felt she was being extorted, etc. You can also sue the woman for criminal trespass if she left her car and walked around inside your apartment. And if the car crashed through near the front door and prevented you and your wife from leaving you can try to have the woman charged with false imprisonment.
Do you have renter's insurance? If you do then file a claim with the renter's insurance company. If not yes you can sue the woman in small claims court (or get a personal injury lawyer for go to regular court) and sue for the damage she caused that you have not received compensation for. And yes you can mention the HIV threat. that she threatened your wife.
Can't sue, but can file a police report and have her charged.





If her insurance company does not pay for the repairs to your place, you can sue for damages.
You can't sue her for making threats. You can file a police report though.
Your wife can't sue her for making threats because she has no damages to sue FOR.
